First Amended Complaint

Plaintiffs allege that Defendant misclassified two groups of employees as exempt from receiving overtime compensation:  (1) client services supervisors (including those with similar job titles) and (2) managers (including branch managers and on-premises managers).  Plaintiffs allege that these employees are entitled to overtime compensation for all hours worked in excess of 8 per day, in excess of 40 per week, and for hours worked during the seventh consecutive workday.  Plaintiffs allege that these employees are entitled to damages for Defendant’s failure to properly track actual hours worked.  Plaintiffs further seek monetary relief for those employees who were terminated by Defendnat.  Click here to view the First Amended Complaint in Adobe Reader (.pdf) format.  Click here to download Adobe Reader.
